Pode o mecanismo Data Privacy Framework servir como alternativa regulatória para o sistema de transferências internacionais de dados pessoais brasileiro?

Resumo

The present dissertation aims to investigate whether the bilateral agreement model of the U.S.-EU Data Privacy Framework can serve as a regulatory alternative for Brazil concerning international transfers of personal data. Brazil has protective regulations inspired by the European model, is building its system through regulation, and tends to follow the actions of the European framework. The issue of international personal data transfers has historically been a point of contention between two blocs: the United States, which adopts a more commercial perspective advocating for the free flow of information, and the European Union, which defends a more protective approach toward individuals, requiring safeguards for data transfers. Regulators from both sides have previously established bilateral agreements that were invalidated by the European Court of Justice. In July 2023, regulatory bodies from these countries announced a new agreement to enable the flow of information. The Brazilian National Data Protection Authority (ANPD) has not yet issued adequacy decisions nor obtained an adequacy decision from the European Commission.This qualitative and theoretical research conducts a documentary analysis of the adequacy decision on the EU-U.S. Data Privacy Framework and a review of academic literature, aiming to determine whether this framework could be an alternative to the adoption of standard contractual clauses by Brazilian companies for transferring personal data to the United States.
