Resumo

This study aims to reflect upon the production of racism within the Brazilian state's justice system, in order to understand the role of law in the face of the contradiction inherent in a society that portrays itself as democratic while simultaneously permitting inequalities that challenge the very concept of democracy, such as the mass incarceration of the Black population. To achieve this, a legal analysis will be conducted on case number 0008566-71.2016.8.19.0001 from the 39th Criminal Court of the District of Rio de Janeiro, which led to the second conviction of Rafael Braga Vieira on charges of drug trafficking and criminal association (Articles 33, 35, and 37 of Law 11.343/2006), contextualized within the historical background of the case. Through the examination of this case, the study presents the typology of the "keep imprisoned" penalty, a mechanism employed by the Judiciary as a decision-making qualifier that reflects the racial bias inherent in police stop-and-search and judicial decisions concerning black people.
