Resumo

In this paper, the author discussed about the characteristics and the context surrounding independent monitorships (as they are commonly known)2 resulting from leniency agreements in Brazil, bringing light to the lessons learned until this moment and the difficulties imposed today. In this context, the central question made by the author was how to improve the imposition of monitorships within the context of leniency agreements resulting from corrupt activities – this was the center of this paper. The methodology that was used included the analysis of leniency agreements that imposed monitorships (including its specific clauses), the analysis of similar agreements in the United States, and interviews with relevant independent monitors. As a result, the author differentiated the different types of monitorships used today in Brazil, discussed their characteristics and the regulation in force, and pointed out which are the gaps and contradictions that bring legal insecurity to the relevant partiers. At the end, the author debated possible solutions to be presented and incorporated within the negotiation of leniency agreements held with enforcement agencies, such as the agreement between authorities that are signatories of different leniency agreements on which of them will be responsible to impose a monitorship and the provision of which type of monitorship will be applied depending on the complexity and seriousness of the offense.
