Resumo

This study analyzes the development and legitimacy of the Autonomous Social Services (SSA) in Brazil, with a special focus on the so-called “new generation” SSA (SSA-ng). The research examines the historical context, legal characteristics, and doctrinal classifications of the SSA, as well as the jurisprudential evolution regarding the acceptance of their non-traditional forms. Using a case study approach, the work begins with an analysis of the general context, including examples of judicial decisions involving various SSA at the national level and the consolidation of legal interpretations, before moving on to the specific case of the São Paulo Agency for the Promotion of Investments and Competitiveness (Investe SP). In this case, the positions of the State Court of Accounts and the State Attorney’s Office of São Paulo are analyzed. Thus, the research into both general and specific case studies sought to demonstrate whether and how practice aligns with theory, how the model has evolved, and how it has ultimately been accepted by academia and the courts. The analysis reveals the complexity and heterogeneity of the SSA, highlighting the challenges in their legitimation and the attempts at categorization. The study concludes that, despite doctrinal criticisms, the courts have recognized the validity of the new generation SSA, considering them legitimate instruments for the modernization of public administration, provided they maintain certain essential characteristics (being established by law and having purposes related to social rights) and are subject to appropriate mechanisms of control and oversight.
