O Recurso Extraordinário 635.659/SP e seus potenciais efeitos sobre as prisões no Estado de São Paulo, no período de 2010 a 2020

Resumo

Objectives – The objective of the study was to gather data related to drug trafficking in the State of São Paulo. Specifically, it aimed to analyze the profile of drug trafficking in SP, considering characteristics such as the racial profile, professional occupation, gender, among others, of the accused, and to understand how the classification of trafficking and possession would change if a quantity rule capable of distinguishing between the two types of crimes were established. Methodology – The data were obtained through consultation with the Citizen Information Integrated System of the Government of the State of São Paulo, resulting from the Access to Information Law. Results – As results, we have the increase in crimes related to drug possession and trafficking. The majority of the individuals charged have a low level of education, with no prevalence of ethnicity or race, mostly men, young, without a profession or source of income. Pratical contributions – Immediately, it will be possible to determine, in case of the decriminalization of drug possession by RE 635.659/SP, the percentage of cases covered by the decriminalization. With the decriminalization of possession of up to 40 g of cannabis, a total of 261,255 cases would be decriminalized, which corresponds to 56.7% of crimes involving cannabis, or 21.6% of crimes involving all types of drugs.
