O papel do Laboratório de Jurimetria e Inovação Jurídica (LABJUD) no aprimoramento da representação judicial da Fazenda Nacional

Resumo

Purpose: this research aims to understand how the work developed by the Laboratory of Jurimetrics and Legal Innovation (LABJUD) has contributed to the improvement of the judicial representation activity performed by the Attorney-General of the Public Finances office (PGFN).
 Methodology: this qualitative research takes the case study approach. In addition to the analysis of public documents, interviews were conducted with the public servants who work in the sector, and with managers of the judicial representation of the PGFN who have already had the opportunity to work on projects conducted by the LABJUD.
 Findings: the research indicated that, despite its reduced staff, the creation of the sector in 2019 contributed to the consolidation of an institutional culture more attentive to the role that analysis of statistical data and search for empirical evidence tend to play in the provision of legal services, as demonstrated by deliveries already made by the sector in its three axes of action: i) jurimetrics; ii) management/innovation and iii) technology. Regarding the jurimetrics axis, deserves highlighting surveys carried out to assist in the tax reform project proposed by the Ministry of Economy and in the acceptance, by the Federal Supreme Court, of the request for modulation of effects formulated by the PGFN in the judgment of Theme 69 of the General Repercussion, which generated savings to the public coffers estimated at R$ 230 billion. As for the management/innovation axis, the main achievement of LABJUD was the idealization and implementation, within the scope of the PGFN, of the National System of Judicial Representation, which innovated in the organization's model by allowing people stationed in different locations to act in an integrated manner, with data-oriented workflows and analysis of quantitative and qualitative aspects of the legal activity. As for the technology axis, the results confirmed the importance of the development of technological tools focused on the automation of legal routines, access to legal guidelines, and production of managerial information.
 Research Limitations: in order not to compromise the achievement of the research purposes, more related to the organization, structuring, and deliveries of the sector, it was not possible to explore in greater depth technical aspects related to statistical notions and technological tools applied in its projects.
 Practical Implications: despite the expressive results achieved by the LABJUD, the research reveals to PGFN the need to expand the team and investments in the sector, as well as to improve the public disclosure of the jurimetric surveys, which can greatly contribute to the public debate regarding improvements in the Brazilian tax litigation system.
 Social Implications: the research has revealed that the LABJUD´s structure, organization model, and results can inspire other bodies of the Public Advocacy in Brazil to create similar sectors, contributing to the improvement of their judicial representation activity.
 Originality: this is the first known research about a sector of the Brazilian Public Administration dedicated to the activities of jurimetrics and the development of technological tools aimed at improving workflows and judicial strategies in Public Advocacy.
