O juízo 100% digital e a administração da justiça pós-Covidcontrovérsias

Resumo

This dissertation deals with the controversies surrounding the 100% Digital Judgment and the administration of justice after the Covid-19 pandemic. The general objective was to clarify the controversies surrounding the insertion of the 100% Digital Court and the Administration of Labor Justice in the aftermath of the Covid-19 pandemic. The methodology used was a case study. The results showed, through the review of national and foreign literature, that there are two distinct approaches, one related to the existing positions regarding the changes caused by technology in the judiciary and the other related to public policies with interconnection with the 100% Digital Judgment. It was identified that the institutional framework does not offer incentives to the adoption of the practice and that the normative retrogression investigated caused legal uncertainty to the operators of the law. Finally, the data provided by the National Council of Justice and the Regional Labor Court of the 5th Region allowed the demonstration of how the 100% Digital Judgment, unquestionably, is an innovation in terms of procedural procedure. It was concluded that the study on the 100% Digital Judgment points to numerous other possibilities for further research, such as the need to highlight the changes verified in terms of productivity and effectiveness; accessibility of the Brazilian citizen to the Judiciary; digital inclusion; the budgetary impact on the exchequer; the issue related to the contribution of sustainability in relation to the environment, and the psychological aspects of this form of action, in addition to continuing education on the insertion of technology in institutional arrangements within the scope of the Administration of Labor Justice.
