O diálogo como ferramenta restaurativapossíveis caminhos para a mediação de conflitos na Comunidade Santa Marta

Resumo

The complexity of present-day relationships has made it evident that relying solely on the traditional notion of jurisdiction is not enough to address all disputes that are bound to occur at an increasingly faster pace. Given this scenario, the so-called methods of alternative dispute resolution gained prominence, either because of their potential to relieve the judicial system, or due to the possibility and dissemination of a culture in which individuals are the protagonists in solving their own conflicts. Considering that these paths go beyond the simple notion of relieving the courts and effectively contribute to social pacification, the present work has as its object of study the application of mediation tools in the context of the Santa Marta community. Far from seeking a definitive or infallible answer to all conflicts, the article, based on qualitative and quantitative research, proposes the encouragement of dialogue as a transforming instrument capable of contributing to social inclusion.
