O controle da justificativa do uso de algemas após a edição da súmula vinculante 11

Resumo

The paper analyzes how the Judiciary views the  use of  handcuffs  after the  edition of the 11thBinding  Precedent  in August 2008.  The goal  is understand how  should bean  effective  position of the Judiciary  so that the  Binding  Precedent  does not become  obsolete  and ineffectivein everyday Courts. For this, it will be introduced some controversial points and its interpretation bases according to the  elaboration purpose of  the precedent  and the constitutional dirigisme, which are: absolute nullity of the justification, abdication  of concrete damage to characterize the nullity and factual verification  of the requirements  of Bidding Precedent.  Finally,  we conclude that  the total of these  requirements  are necessary elements for the Binding Precedent 11 does not become an inert and ineffective orientation in controlling  everyday arbitrariness
