Resumo

The subject of infrastructure sharing has been a matter of interest to governments, regulated industry agents and researchers worldwide. In Brazil, the pole infrastructure, which is monopolistically owned by public electricity distribution utilities, represents an essential facility for the activity of certain segments of the telecommunications sector. Despite the efforts made by ANEEL and ANATEL to facilitate the sharing and efficient use of masts by the electricity and telecommunications sectors since the LGT was published, the regulatory framework associated with the sharing of poles infrastructure has resulted in a series of externalities for all the agents involved. These include market failures, disorderly occupation of the infrastructure, urban damage, regulatory and social costs, and conflicts that are difficult to reconcile. In 2020, the controversial scenario underwent a transformation with the joinly design by the Agencies of a Regulation Proposal, which aimed to establish alternatives to the challenges that arose from the current context on the subject. This exploratory research will seek to identify the main challenges for sharing and how they can be overcome. This will be achieved through a qualitative analysis of the regulatory proposals formulated by the Agencies, a study of the contributions of agents to the public debate, a bibliographical review and an analysis of qualitative empirical evidence associated with semi-structured interviews conducted with agents from the electricity and telecommunications sectors. As will be demonstrated throughout this paper, the ecosystem surrounding the sharing of resources comprises complexities that must be definitively addressed by regulators and agents from downstream industries. These complexities have the potential to impact technological and economic development, the achievement of regulatory agendas for significant connectivity and network resilience, and the lives and safety of thousands of workers and users of public electricity and telecommunications services in the country.
