O compartilhamento dos postes de luz nos setores de telecomunicações e distribuição de energia elétrica

Resumo

The telecommunications sector is historically influenced by new technologies. In Brazil, the telecommunications were exposed to cycles which encompass a period in which its network were poorly interconnected, followed by another in which the telecommunication were essentially considered public services, due to its recognized strategic character, and a phase in which they were comprehended as private activities, based on an strategic necessity of attracting international investments for the sector’s development. The recent recognition by the Brazilian Executive Branch of its essentiality, during the Sars Covid-19 pandemic, emphasizes to its market players and regulator the necessity of searching ways that would allow the development of the telecommunications efficiently, under an economic perspective. This necessity is also justified by the fact that the sector will be reasonably impacted by a new cycle, caused by the imminent entry from the Fifth Generation technology. This work pretends to analyzes an intersectorial phenomenon, which by its nature reveals itself as an alternative to the development of the networks essential to the telecommunication: the sharing os lampposts. The work starts with a diagnosis from the markets involved in the phenomenon, and follows with an examination on the effects observed by the rules and legislation produced by the Brazilian regulatory bodies with regards to the sharing of lamppost. It concludes with the presentation of certain regulatory alternatives to its market players and regulatory bodies in order to allow its development in efficient basis.
