Justiça digital e sua governançaentre eficiência, riscos e centralidade do usuário

Resumo

This study analyzes the digital transformation within the Brazilian Judiciary and its impacts on judicial activity. It begins with the phenomenon of hyper-litigation and the growing digitalization of Justice, a process that, while enhancing efficiency, also exposes vulnerabilities and risks. Based on a qualitative approach grounded in literature review, normative analysis, and case studies, the research investigates the risks arising from the use of technology in the judicial system, as well as the deterministic character of technical solutions. Subsequently, it examines the governance and management structures of Information and Communication Technology established by the National Council of Justice and by the Courts, identifying this framework as an initial solution to contain risks and mitigate technological determinism. The findings, however, reveal that despite progress, significant gaps remain in ICT governance and management. As a response, this work proposes user centrality as a strategic axis, repositioning users from the condition of mere recipients of services to active agents in the formulation of guidelines, performance monitoring, and evaluation of results. The goal is to reduce risks, mitigate technological determinism, and strengthen Digital Justice, making it increasingly efficient, inclusive, and legitimate.
