Inovação na solução de casos públicosanálise do caso da CEAGESP

Resumo

The present dissertation has the aim of answering a focal question of researches: how to handle the legal insecurity which has been provided by the Departments of Regulation? In order to answer this question, this study has elected for its methodology the case study of CEAGESP aiming to illustrate the consequences from the regulatory uncertainties which have been caused by the control from the Brazilian Court of Auditors - Tribunal de Contas da União (TCU )- on the model of commercial exploitation of public good. Therefore, it has been processed the first perspective on contextualizing the case, including all of its nuances. Subsequently, in which ways it had been practiced the control from TCU over the governance model from CEAGESP and, finally, it has been indicated an innovative solution in order to deal with the legal insecurity created by the control, by the creation of a legal instrument, which can be able to reflect more compatible with the reality of the case decisions.
