Resumo

The thesis aims to propose indicators of the rationality of regulatory decisions. Taking the economic theory of regulation and behavioral economics as a starting point, the work establishes the premise that the regulator, like any human being, has limited rationality and is subject to interference resulting from bargaining, capture, heuristics, biases and noise, which have the potential, in many cases, to give rise to regulatory failures. In order to mitigate the practical effects of these interferences, the thesis aims to contribute to the construction of a theoretical basis to help regulators in their quest to reinforce the rationality of their decisions, or, alternatively, to subsidize the task of controllers in reviewing rationality. To this end, the thesis proposes a catalog of indicators of the rationality of regulatory decisions, whose greater or lesser presence will imply lesser or greater openness to control, based autonomously on the violation of the formal and procedural elements of the Rule of Law.
