Resumo

Objective: to identify the results produced by inverted social security executions in the enforcement phase of the sentence. Secondary objectives include calculating the acceptance rate of inverted executions, estimating the potential financial impact on social security budgetary expenses with inverted executions, and establishing a comparative analysis of the progress in the enforcement phase with and without inverted executions. Methodology: from a scrutiny of 333 original judicial records, serving as a statistical sample, various qualitative and quantitative details were recorded to assess the occurrence or absence of inverted social security executions. This involved documenting approved arrear amounts owed to the plaintiff/insured, the corresponding figures proposed by the National Institute of Social Security (INSS), and the plaintiff/judicial accounting. Additionally, procedural movements related to final judgment and judicial approval were. Results: inverted executions are accepted in enforcement proceedings, approximately 78.07%. Assuming all enforcement proceedings followed the traditional process, the INSS would have an increase in judicial social security expenses ranging from 8.99% to 28.89%. A simplification in procedural progress was observed with inverted executions. Limitations: the study is limited to judicial enforcement proceedings of social security accident cases that concluded with the issuance of precatory orders by the State Court of Justice of Paraná (TJ-PR) against the INSS. Applicability of the Work: confirming the results through the practice of inverted executions can benefit the Institute by providing guidance for simpler work processes, delivering higher-quality judicial services to society, and the potential reduction of judicial social security expenses. Contributions to Society: the observed benefits in the research can be directed towards society in general, with a reduction in social security budgetary expenses, efficiency gains in judicial processes, and a decrease in the backlog of social security judicial cases, ultimately leading to a reduction in social costs. Originality: The main strength of the work lies in a detailed examination of the intricacies of various judicial records to understand how the practice of inverted executions functions, providing scientific support for the respective results.
