Resumo

The National Constituent Assembly of 1987-1988, inspired by the decentralization of power as a synonym for democracy, in contrast to the centralized and authoritarian regime of the 1967- 1969 Constitution, reinforced the legislative monopoly of the Union, at the expense of the demand for decision-making autonomy by subnational entities. This study seeks to answer the following question: how was it possible, in a constituent process aimed at decentralization, to reinforce the legislative monopoly of the Union? The hypothesis, based on the theoretical assumption that the 1988 Federal Constitution would not be an exception to the state centralization movement that began in the 1930s, is that the 1987-1988 constituent maintained the supremacy of the Union to regulate and supervise the constituent units, preserving its broad authority in legislative initiatives. Through the analysis of documents produced at all stages of the constituent process related to the division of federative powers, the study identifies how the constituents addressed the paradox between centralization and decentralization and the elements that justified the maintenance of a model that tends toward the centralization of powers in the Union. Thus, the study contributes to the debate in the literature that highlights the continuities of the federative models of previous constitutions in the 1988 Federal Constitution.
