Do grito à prisãouso do discurso punitivo por movimentos identitários para mobilização de políticas públicas de segurança

Resumo

This research aimed to examine the use of punitive discourse by identity movements in the creation or modification of public security policies, particularly concerning demands for criminalization or the intensification of penal measures as a means of protection and response to historical and systemic violence. In light of the review of punitive logic, particular attention is given to the Manichean dynamic of "us" versus "the others," supported by the construction of archetypes and stigmas that caricature the "other" to be combated, which has significant consequences for the development of public policies. To this end, the text begins with a theoretical foundation on the relationship between discourse, power, and politics and presents the adopted methodology, critical discourse analysis. It then progresses to a bibliographic overview regarding the concept of punishment, criminal justice in Brazil, some of the critical contributions from criminal law and criminology, as well as the main works that link the political spectrum of progressivism with the adoption of punitive logic in proposing solutions in terms of public security and the protection of social minorities. In the following chapters, it reflects on the operational patterns of the prison system and applies the methodology to three observed events, namely: (i) the criminalization of homotransphobia, (ii) the increased penalty for racial hate crime, and (iii) the increased penalty for femicide. Finally, it suggests guidelines in favor of restorative justice as an alternative public policy and presents concluding assertions based on provocations such as: does the current rationale of punishment contribute to reducing the violence experienced by social minorities? Furthermore, is there institutional creativity to design a public policy framework that does not use punishment as a response to violence?
