Direito à moradiaum direito social em construção no Brasil : a experiência do aluguel social no Rio de Janeiro

Resumo

The objective of this article is to discuss the right to housing in Brazil and some elements that compose its content, such as the principle of non-removal. The effectiveness of this social constitutional right does not necessarily depend on the private property, but also on other strategies, especially de use of social rent as a public policy. Presenting contemporary legislation that protects the right to housing, and the changes it underwent in the national and international legal system over time. The use of social rent in the state and city of Rio de Janeiro will be used as reference to evaluate the potential of this instrument in the construction of public policies that
 give effect to the right to housing. The French experience, describing the social housing policy as a service of general interest will be taken as an international parameter to propose public policies that advance regarding the use of social rent in Brazil.
