Desafios para a implementação das políticas de alternativas penais no Brasil

Resumo

Evaluating the federal initiatives for structuring the community sanction policy in Brazil, analyzing the impacts of these actions, was the main objective of the research presented. For this purpose, data contained in the Federal Government's budget execution panels were organized, and as information was requested regarding the amounts allocated to the mentioned policy, which allowed the structuring of a database containing all the federal agreements signed with the states from 1997 to the year 2020. Among the main research findings, we can highlight the low prioritization of the community sanction policy in the penitentiary system and the unsatisfactory budgetary and financial execution of the resources destined to it stand out. It was also noted that there is no structured data at the national level on the number of people servig community sanction in the country. The absence of regulation and an adequate governance model are obstacles to overcome the impasses that have occurred between the Union and the States and between the Executive and Judiciary Powers. Based on the governance model proposed by the World Bank, a proposal for the institution of a national system of community sanction was structured, through a legislative amendment that should include: a) the creation of a national management committee to improve the production of regulatory frameworks and integration mechanisms between the powers and between the levels of the federation; b) the allocation of minimum resources for the permanent financing of the policy; c) improving the governance of contracts and increasing legal certainty for the public manager with the aim of optimizing the execution of the resources allocated and; d) the improvement of the policy's transparency with the creation and publication of its productivity, costs and impact indicators for its evaluation and continuous review.
