Cooperação em redes transnacionais de reguladoresinternalização de normas, legitimidade e controle

Resumo

The present work aims to study the crystallization of soft law through the incorporation, by domestic regulators, of standards created by transnational regulatory networks. It analyzes this issue from two different perspectives: legitimacy and judicial review. Regarding legitimacy, it argues that the main obstacles for the recognition of incorporated norms as legitimate are the accountability gaps verified on the global level, as the domestic constituencies, which would have the right to participate on agency rulemaking procedures, may not have access to the transnational regulatory networks rulemaking procedures. It argues, then, that legitimacy cannot be assumed and should be verified on case-by-case basis. Moreover, it suggests a series of standards that might be employed so as to assess legitimacy. It also states that, if domestic constituencies cannot have access to transnational regulatory networks, it is domestic regulators’ duty to act so as to mitigate the resulting accountability gaps. Regarding judicial review, it argues that judges should analyze solely the legitimacy of the incorporated rules, assuming a deferential position when it comes to the decisions of the domestic regulators.
