Como a Guarda Civil Metropolitana de São Paulo pode colaborar com o estado de São Paulo na segurança pública, sem interferir nas atribuições da Polícia Militar do estado

Resumo

This dissertation analyzed the role of Municipal Civil Guards (GCMs), with an emphasis on the city of São Paulo, as agents of collaboration in public security without interfering with the responsibilities of the state Military Police. The research question is: Does current legislation permit GCMs to act as police forces in São Paulo's municipalities and grant them the legal powers to effectively collaborate with state public security? The methodology employed was qualitative, exploratory, and descriptive, with document analysis and interviews with authorities in the field. The theoretical framework is based on authors such as Renato Sérgio de Lima, Luiz Eduardo Soares, Sérgio Adorno, Tavares dos Santos, and Rafael Alcadipani da Silveira, articulating topics such as federal governance, police professionalization, and intergovernmental cooperation. The data demonstrate that the work of municipal guards has been crucial in conflict mediation, preventive patrols, and support for public services, especially in peripheral areas. The study highlights that formal recognition of the guard as a public force with a preventive and community-based role strengthens the legal security of the force and expands its sociais legitimacy. The conclusion indicated that the designation "municipal police" is not intended to usurp the functions of the Military Police, but rather to guarantee greater legal security for the GCMs and strengthen the role of municipalities in combating urban violence. Regulatory improvements, federal cooperation, and institutional recognition of the guard as a public preventive and civic force are recommended.
