Resumo
Purpose – The aim of this study was to understand the essential parameters for conducting the regulatory outcome evaluation related to occupational safety and health norms in Brazil. Methodology – A qualitative and exploratory approach was used, collecting data through 18 semi-structured interviews with staff from Inmetro and federal and state regulatory agencies. Findings – The interviews revealed a variety of experiences in the development of the regulatory outcome evaluation: (i) need for training for professionals in charge of the assessments; (ii) difficulty in defining the criteria used to choose which acts to assess; (iii) lack of definition regarding the regulatory problem, the objectives, and the monitoring plan when preparing the regulatory impact analysis; (iv) without the proper consideration of these elements in the regulatory impact analysis, the regulatory outcome evaluation may be compromised. Research limitations – It was not possible to obtain the content of the regulatory outcome evaluation reports from each organization in order to compare them with the interviews and to retrieve details possibly omitted by the interviewees. Additionally, there was a lack of interviews with international organizations, such as the Organization for Economic Cooperation and Development (OECD), which has extensive knowledge in this type of assessment, and with representatives from countries experienced in this kind of evaluation. Another limitation is the low participation of state agencies and the complete absence of municipal agencies. Even though they haven't conducted evaluations, it would be relevant to understand how they monitor their current regulations. Practical implications – This study aims to provide a contribution to practice by investigating the experiences of regulatory agencies and Inmetro in adopting the regulatory outcome evaluation. Social implications – Given the social and economic impact resulting from workplace accidents and occupational diseases, it becomes crucial to monitor and evaluate the legislation that effectively contributes to the reduction of these events. By using such tools in an optimized way, the Brazilian Ministry of Labor and Employment, through labor inspection, may gain a clearer understanding of the regulations under its purview and implement the necessary corrections, thus contributing to the well-being of society. The parameters proposed in Chapter 5, such as the use of monitoring data from the inspection area in the department responsible for overseeing standardization, as well as considering the impact of the severity of occupational accidents as a criterion for selecting the standards to be evaluated, can assist in reducing workplace accidents and occupational diseases.
