Resumo

In this study we analyzed the Anti-Corruption Law enforcement process (Law No. 12,846/13) in the city of São Paulo and sought to answer whether fines are effectively applied by the São Paulo Controller General Office, to enforce the above-mentioned Law. To this end, it was necessary to first identify the bodies involved in the process of accountability of legal entities, and then analyze workflow adequacy of the prosecuting commissions as part of the Administrative Procedures for Accountability of Legal Entities (PAR). In addition, we sought to understand if a judicialization of the matter had occurred, aiming at the non-payment of the penalty in the administrative sphere. In addition, we also sought to identify whether, after the application of the penalty, the City of São Paulo continued to hire the penalized companies and if there exists a concern from the Municipality, in its contracting processes, to actively verify the companies included in the National Register of Penalized Companies (CNEP). Finally, using concepts of corruption, control and public policies, we suggest actions to improve the effectiveness of the application of sanctions and the expansion of preventive policies beyond punitive ones.
