Análise da adequação de indicadores de desempenho de tutela coletiva na Defensoria Pública da União

Resumo

Objective – The aim of the study is to analyze the adequacy of collective protection performance indicators of the Defensoria Pública da União-DPU. Methodology – This research adopts a qualitative approach, with descriptive and exploratory objectives. In relation to the procedures, it is configured as a bibliographic, documentary and case study with a phenomenological perspective, elaborated from the content analysis of data obtained from legislation, institutional documents and semi-structured interviews. Results – The results reveal that the provision of legal assistance in collective protection by the Brazilian Public Defender's Office is not homogeneous; that the existing collective protection performance indicators no longer include an identity and regional focus; that there is a need to carry out an assessment of the relevance, sufficiency and validity of the indicators, as well as the clarity of the proposed objectives and the stipulation of goals, being diagnosed that the DPU has to implement concrete actions to provide greater public governance and accountability, the which results in the construction of public value and transparency in feedback to society. Limitations – The conduct of the research was restricted by the political-institutional scenario of the DPU, in the year 2023; due to the lack of systematization of data on actions in collective protection in the provision of legal assistance and the author's role as an observer and participant in debates to improve indicators, conducted by the institution, simultaneously with obtaining the findings, during the conduct of the research, in a phenomenological way. Practical implications – The findings of this study can serve to support future research on the relevance of systematizing information and processing data for the provision of legal assistance in collective protection with thematic, identity and regional sections in the Brazilian State, which draws parallels with the implementation, monitoring phase and evaluation of public policies. These data can contribute to the existing literature on the subject and assist managers of Public Defender's Offices in implementing performance indicators in legal assistance in collective protection; in the perception of the Public Defender's Office as an agent of public policies due to its performance in extrajudicial strategic litigation; in the public policy cycle in the monitoring and evaluation phases, with the Public Defender's Office appearing as a relevant actor outside the Justice System, in the role of Ombudsman, receiving demands from the population in situations of social, economic and institutional vulnerability in order to guarantee the broad exercise citizenship and guarantee of rights. Social implications – As contributions, the study highlights the importance of institutions paying attention to maintaining alignment between Governance, IT Governance and the systematization of information to guarantee a return to society that denotes the public value generated by public institutions, along the lines of the concepts of governance and accountability. Originality – The originality of the research is present, as no other in-depth studies were found on the analysis of the adequacy of indicators, with regard to alignment with the concepts of generating public value.
