A reforma gerencial e as agências reguladoras

Resumo

In this article, written through a case study, we evaluate the role of regulatory agencies after the Managerial Reform, which happened in 1995, analyzing its institutional evolution and its autonomy. In order to achieve that, we contextualize republican democracy, the reform of public management and the creation of regulatory agencies in Brazil. Based on that, the innovations of this model of special regime autarchy, among them the autonomy of management, independence of decision making, administrative flexibility, identifying the obstacles in the implementation of the autonomy provided by law, the possible impact on the regulation activity and any conflicts with the democratic regime. This discussion also brings up other discussions: the model of republican democracy, the innovations brought about by the reforms in the model of public administration in Brazil and the underlying changes in the relationship between the State and society, culminating in the creation of new institutions such as regulatory agencies.
