Resumo

The present work seeks to analyze how the instrument of the master plan was inserted in the 1988 Constitution and how its concept was transformed in the light of the new list of fundamental rights present in the new Charter. In this sense, the concepts of the social function of property, the social functions of the city and well-being lose their primarily technical conceptions, arising from the science of urbanism, to give rise to interpretations that are predominantly legal and related to constitutional fundamental rights. In consisting in a matter included in the constitutional text, the master plan and urban policy became the object of judicial and academic appreciation, with important precedents of Courts of Justice and Superior Courts, with emphasis on the Federal Supreme Court, which allow us to infer that the Judiciary as a whole has accepted the arguments of the most recent doctrine. However, much of this evolution emerged after the 2001 City Statute, a federal law that detailed how Municipalities should conduct their urban policy and what sanctions are provided for omitted managers. In view of this, the failure to publish the masterplan constitutes illegality and unconstitutionality, against which appropriate and efficient constitutional actions and remedies are available, but which are difficult to bring or succeed in court.
