Resumo

This work intends to analyze, initially based on a study of the literature on the subject, the extent and the completeness of the regime of default interest in order to protect the cooperation that derives from its stipulations. With the objective of translating the analysis to the practical reality of civil law, this essay also proposes a case law mapping of the application of the provisions in said legal regime, in order to draw quantitative and qualitative conclusions that will assist in understanding the applicability and possible incompleteness of the default rule when the creditor's collaboration is required.
