A judicialização da educação especial no estado de São Pauloum estudo sobre a atuação da advocacia pública sob a perspectiva estrutural

Resumo

The text analyzes how the judicialization of special education influenced public policies in the state of São Paulo, leading the government to improve its actions and adapt them to the social paradigm of disability and inclusive education. Despite institutional progress and advances in the role of the State Attorney General’s Office (PGE/SP), the Judiciary maintained a reactive stance toward the new policies, mainly due to their lack of effective implementation and experimental nature, such as the inclusion of support professionals (PAE/AE) in classrooms. The author highlights that although the PGE/SP has evolved by adopting a form of litigation more oriented toward policy debate and less tied to old principles such as the supremacy of the public interest and strict legality, individual judicial claims persist and face bureaucratic resistance. A recent decision by the São Paulo Court of Justice, favorable to the new special education policy is seen as a potential turning point, aligning with the judicial experimentalism advocated by the Federal Supreme Court. Finally, the text argues that judicial debate on public policies should be more pragmatic, recognizing the material and administrative limits of the State. The author suggests that dialogue among the public administration, the Judiciary, and society is essential to legitimize experimental policies, reduce litigation, and avoid unnecessary public spending resulting from judicial decisions that overlook the practical feasibility of public management.
