A evolução do desenho da política previdenciária brasileira (1923 a 2022)

Resumo

This dissertation had the general objective of analyzing the evolution of the design of the Brazilian social security policy between the period from 1923 to 2022, observing the target audience, benefits and source of funding, treated, respectively, as elements and instruments of the design of the policy. In order to achieve this objective, the specific elements of the policy were analyzed, namely: the target audience and the funding instruments and benefits of the social security policy in the period between 1923 and 2022. The study made use of the data collected in the main legislations, concentrating -as in four phases: the first in its origin, in 1923, with the Eloy Chaves Law, until the year 1959; the second with the enactment of the Social Security Organization Law, in 1960, following its analysis until 1975; the third with the Consolidation of the Social Security Law, which lasted until 1990; and, finally, the fourth phase, with the 1991 General Social Security Regime, which persists to the present day. The study used qualitative research, using the content analysis of 205 theoretical and legal texts, of which 58 normative texts. The research results allowed us to understand how the design of the social security policy evolved over the years. Therefore, an expansion of the target public is identified, since only employees of the Brazilian railroads were served by the system and, now, every society, economically active or not, participates in it, so that, contemporaneously, the range of benefits projected reached the result of the mentioned evolution, as well as the expansion of the source of costing of the benefits, considering the maintenance of its sustainability. It is identified that the design of the policy has an incremental character over time, continuously expanding its scope in the three selected dimensions. Finally, it appears that Brazilian social security was coupled within a larger institutional arrangement, referring to the social security policies provided for by the Federal Constitution of 1988.
