A eficiência dos programas de integridade dos fornecedores da Prefeitura de São Paulo

Resumo

The dissertation analyzes the effectiveness of integrity programs required from suppliers of the Direct Administration of the São Paulo City Government, considering both national legislation and subnational regulation. It is based on the premise that the mandatory nature of such programs, especially in large-scale contracts, must be proportional to the institutional and economic reality of the contracted companies. The study adopts a mixedmethod approach, combining quantitative and qualitative perspectives, grounded in primary data obtained through the Access to Information Act and in public evidence disclosed on the companies’ institutional portals. The sample was stratified according to contract value ranges, with emphasis on contracts above R$ 1 million, and the analysis was based on the 17 criteria established in Federal Decree No. 12,304/2024. The results reveal a generally low level of compliance with the legal criteria, even among suppliers with high contractual volumes, as well as a strong concentration of companies in the initial stages of maturity. To deepen the assessment, an adaptation of the Internal Audit Capability Model (IA-CM) was applied, allowing for the classification of the institutional maturity of the integrity programs. The findings indicate that integrity programs still display a predominantly formal character, requiring regulatory and institutional adjustments. It is recommended that proportional and gradual models of requirements be adopted, along with greater normative harmonization among federative entities, in order to strengthen the effectiveness of the public integrity policy.
