Resumo

This acadmic work approaches the double requirement of capital that ends up penalizing the cooperatives that belong to the cooperative systems, having more capital of these institutions when detected with the traditional banks. Current legislation does not observe the peculiarities of cooperative systems and ends up forcing these institutions to reserve capital in the process of centralizing the resource in their central, even when there is no increase in credit risk. Brazil has two cooperative systems that have banks in their composition: Sicoob System and Sicredi System. These two systems are the largest in Brazil and have more than 14 million official members throughout the country. The academic work in question analysed, through the registered monitors released by the Central Bank of Brazil, the impact of the double capital requirement in these two systems, showing the volume of credit that does not reach the cooperative due to the excessive capital requirement. The solution lies in changing the current legislation, in particular the amendment of two articles of Resolution 3644 of the National Monetary Council, which will allow the capital requirement not to apply to the resource centralized by the cooperatives in their central, provided that the resource is directly to the system bank. It is important to highlight that the alteration does not change the capital requirement on the central when the resource is directed to the system's bank, but eliminates the double capital requirement. Finally, the double capital requirement prevented more than R$ 25 billion from reaching cooperative members in 2022 through credit operations and, thus, ended up discovering the potential for growth in the representativeness of cooperatives in the National Financial System.
