Resumo

The purpose of this work is to analyze the role of the Brazilian Federal Supreme Court (STF) in defining the constitutional criteria for recognizing an employment relationship in cases involving service agreements through legal entities, with special focus on Constitutional Complaint No. 61,492. "Initially, the evolution of the jurisprudence of the Brazilian Supreme Federal Court (STF) is examined, starting from the Argument of Non-Compliance of a Fundamental Precept (ADPF) 324 and the Extraordinary Appeal (RE) 958.252 (Theme 725), which consolidated the legality of outsourcing and pejotização, the practice of hiring workers as legal entities, within the Brazilian legal system.Subsequently, outsourcing is examined in light of Comparative Law and the judgment of Constitutional Complaint No. 61,492, with emphasis on the constitutional grounds relied upon by the Court and on the criticism of the automatic recharacterization of civil contracts by the Labor Courts. Finally, the study addresses the institutional tension between the STF and the Labor Judiciary, analyzing the decision’s impact in the broader context of consolidating a binding precedent system and legal certainty in contemporary labor relations.
