Resumo

New technologies contribute for capturing a higher amount of data, including different sorts of data and through high processing capacity based on algorithms, initiatives related to personal data validation with facial recognition and to identity verification with fingerprints have been coming up. This type of technology also become relevant in a scenario where the correct identification of users during the process of access to public or private services is necessary for businesses and the government in general, based on security standards and fraud protection. Thereby, this work proposes a case study based on the “Datavalid” service, developed by the “Serviço Federal de Processamento de Dados” (SERPRO). This service consists in an application-programming interface (API), that can be also used and paid by private entities, allowing them to send personal data (including biometric data) to be validated in publics database, built by governmental entities. We have explored legal aspects of validation data services based on “Datavalid”, in a perspective of privacy and personal data protection. We also recommended changes in its legal structure in order to be compliant with the applicable laws and principles. At the end, we organized the conclusions related to “Datavalid” to other similar initiatives, resulting in a framework for assessment this type of system.
