Risco regulatório em telecomunicaçõesanálise da polêmica sobre o reajuste das tarifas pelo IGP-DI

Resumo

This study has two objectives. The first is to analyze the Brazilian telecommunication institutional endowment, following an approach developed by Levy and Spiller (1993). The second is to investigate several aspects of the legal dispute regarding validity of the readjust of tariffs of local phone calls by the IGP-DI price index (Índice Geral de Preços – Disponibilidade Interna – IGP-DI). This episode had great repercussion among several audiences: the Executive and the Judiciary, the organizations that defend the interests of the consumers, the telecommunication companies and the financial market, and it represents a unique opportunity to evaluate the maturity of the telecommunications regulatory system. The decision of the Supreme Tribunal of Justice (Superior Tribunal de Justiça – STJ) to maintain the readjust by the IGP-DI price index has great importance for the institutional endowment. The analysis is focused on the fixed local telephony, and there is an emphasis in respect to the tariffs to the consumer. The telecommunication sector is of prime importance in respect of the direct investments in the country, and it has a central role in the context of the technological convergence of the New Economy.
