Resumo
Objective – This study intends to demonstrate how structural racism influences black representation in high-ranking positions in the legal careers of the State of Rio de Janeiro, from the perspective of black civil servants who occupy relevant positions in the institutional hierarchy. Methodology – This is a qualitative research carried out through the documentary analysis of 8 public notices and results of the phases of public tenders to fill the careers of prosecutor, prosecutor, judge and defender of the State of Rio de Janeiro (ERJ) after the implementation of quotas in 2011 to 2021. Semi-structured interviews were also used with 11 high-ranking black public servants, who work in the respective institutions of the legal area of the State of Rio de Janeiro, with the application of content analysis (CA) in the collected data. Results – One of the results found was the absence of racial data in the institutions surveyed, which can make the problem of low black representation in the Public Administration (AP) invisible. The data collected showed an underrepresentation of blacks in the AP to the detriment of a white majority. As for the quota policy, the data indicate the existence of flaws in its implementation, as well as the lack of monitoring of the policy, which, without management analysis of its results and effects, suffers from a fragility that threatens its maintenance. Finally, structural/institutional racism was pointed out by the respondents as a possible cause for this phenomenon. Limitations – The lack of racial data in the institutions was the main limitation of the research, which also found it difficult to access the target audience, especially magistrates. Another limitation was conducting the interviews through the zoom app, given the social restrictions imposed by the Covod-19 pandemic. Finally, there is a limitation regarding the CA and possible biases in the data analysis, a characteristic fact in qualitative research. Practical contributions – The research intends to promote the debate about the structural racism present in the legal institutions of the ERJ and how it influences the representation of blacks in these spaces of power. Regarding the quota policy, the research intends to contribute to the dialogue on the policy, the need for monitoring and improvement, essential for the maintenance of the policy after the legal review scheduled for 2022. Social contributions – By questioning the low black representation in the body of public bureaucracy from the perspective of structural racism, we open a window for debate, for discomfort, for the recognition of the problem and the adoption of the necessary measures to change this racist and unequal reality. Furthermore, considering the political and social costs of the policy, it is expected that this study will contribute so that the state response to this demand can be more adequate and consistent with social aspirations. This study also contributes to giving voice to a group historically little heard and represented in the Brazilian context. Originality – Despite the increase in the debate on racism within society, the focus of racism influencing the effectiveness of the implementation of the affirmative policy of quotas in public tenders is a topic that has been little explored and that urgently needs attention to foster the debate. Furthermore, no studies were identified in the Scopus and Web of Science database, considering the context of this research, in the legal area of the state of Rio de Janeiro.
