O paradoxo paralisante da gestão pública no cumprimento de decisões judiciais no INSS

Resumo

Objective – The objective of the study is to describe the paradox with paralyzing potential in the fulfillment of judicial decisions in the context of INSS managers, focusing on its consequences, such as the blackout of pens or excusable errors by LINDB. Methodology – The research was developed through a case study with a quantitative bias that used information from official reports of several agencies, such as TCU, CNJ, IDB and INSS, as well as from the descriptive statistical analysis of data collected through a survey answered based on the perception of INSS managers with sections on a Likert scale aiming to verify patterns. The data were triangulated to enable inferences. Results – The results suggest that the greater the fear of being punished, the lower the appetite for risk in carrying out the activities under the managers' jurisdiction, a relationship that is enhanced when it comes to managing legal demands, with the manager having more fear and less propensity for efficiency in carrying out their activities, contributing to the occurrence of negative effects of the phenomenon under study, such as pen blackouts and excusable errors. The findings also suggest that improving communication and inter-institutional cooperation may be the best path to follow, but others should be followed, such as replacing part of the workforce, improvements in Digital Transformation and Technical Cooperation Agreements. Research limitations – The study focused on contextualizing the paradoxical problem and demonstrating negative consequences, presenting indications for improvements that need to be further investigated in future studies. Possible sampling biases also need to be considered. Applicability – The study is applicable to improving inter-institutional relationships with a focus on increasing public efficiency. Pratical contributions – The findings may be useful for risk management in institutions. Social contributions – The improvement in efficiency, based on the correct diagnosis of problems in this work, directly benefits managers in terms of greater security and the population with faster and more correct recognition of rights. Originality – The study explores a common theme, but still little studied scientifically.
