O novo código civil chinês e suas aplicações às relações comerciais sino-brasileiras

Resumo

This paper aims to analyze the recently approved Civil Code of the People's Republic of China and its implications for international contracts, in particular, from the Brazilian
 perspective. Approved on May 28, 2020, the Code will come into force on January 1, 2021, revoking 9 laws. Unprecedented in the so-called “modern China” it is it’s first legislation to be called “Code” and it marks an equally unique political moment. For this study, historical,
 philosophical and legislative analysis were carried out to better understand the assumptions, conditions and objectives of this new legislation. With a greater focus on contractual provisions, the devices with the greatest impact on international business were studied, offering, in the end, an authorial translation of many.
