Resumo
This thesis seeks to answer the following research question: what are the main paths of policy in the Brazilian Federal Prosecution Service (MPF) and what do they have to do with the concrete functioning of this public organization? It is argued that the policy paths that cross the MPF cannot be confused with: i) institutional variables, which would delimit the behavior of prosecutors in this space, and; ii) with “voluntarism”, as a shaping element of the intentions and conceptions of the MPF members. An exploratory sociography of the Prosecutors General of the Republic (PGRs), heads of the MPF who served from 1989 to 2020, gave rise to this work, revealing that: i) they were all appointed by their predecessor superiors to senior positions throughout their careers in the MPF; ii) from 1993 onwards, they occupied higher positions in the MPF administration, and; iii) those chosen for the PGR based on the triple list of the ANPR worked in this private association, whose official objective is to defend the corporate interests of the members of the MPF. For each of the three findings, an autonomous article is dedicated, which integrates this thesis in form of a chapter, in the same order, but which are interconnected: theoretically, linked to the Weberian tradition of studies on bureaucracy and organizational elites; empirically, due to source research. A new perspective of analysis is offered for the MPF that considers organizational and elite aspects. In the first chapter, the role of designations in the context of the MPF is analyzed and two novelties are presented: i) the use of a literature to think about the context of the MPF as a space of action regulated by formal and informal rules, marked by conflict and power disputes, and; ii) the analysis of a yet unpublished database on the career of the PGRs who have held office since 1988, that serves as a record of individual activity. Since the aspect of governability of the MPF over designations reflects a tension between formal authority and social power, whereas its operation may not coincide with public interest, the ensuing prospects for democracy and the rule of law are problematic, in addition to other issues outlined in previous studies dealing with the MP. In the second, the hidden face of power in the MPF and the agenda power of its leaders are analyzed and two novelties are presented: i) the use of a literature that allows analyzing the power of a structure of domination and of those who seek to control it, highlighting the hidden face of this power; ii) the analysis of a yet unpublished database on the careers of the eight PGRs who have held the position since 1988 and on the composition of the Superior Council (CSMPF), the Coordination and Review Chambers (CCRs) and Internal Affairs, that serves as a record of individual activity. The institutional mechanisms that are used by MPF leaders in their struggle for political power are related to the reproduction of an organizational elite. The result of this struggle needs to be understood as an expression of institutionalized power that the leaders convert into political power, whose hidden face is one of its most outstanding features. In the third part, the political action of the National Association of Brazilian Federal Prosecutors Service (ANPR) boards since the association was founded in 1973 is analyzed and two novelties are presented: i) it uses a literature that allows dealing with the ANPR as an organization aimed at institutionalization, but also at the institutional change, and; ii) content analysis, a yet unpublished database composed of the annual rendering of accounts of the ANPR boards, that serves as a record of its leaders activity over a period of more than four decades. The ANPR is one of the main paths of policy that crosses the MPF. The stability of this private organization and how its leaders, without abandoning the career of prosecutor, exploit institutional “gaps” to make policy from the public structure are remarkable. There is a “sui generis” confusion between a structure of bureaucratic domination (MPF) and a private organization (ANPR) focused on the power projects of “professional politician prosecutors”.
