Lei de acesso à informação pública e seus possíveis desdobramentos para a accountability democrática no Brasil

Resumo

In the last few years, dozens of countries have enacted freedom of information laws with the alleged objective of assuring transparency and reinforcing democratic accountability. On the 18th of November, 2011, Brazil became the 89th country in the world with a Freedom of Information Act (FOIA). The 12527 Act came into force in May 2012, once the text established 180 days for its implementation. The challenge is to turn the Act into an effective instrument of support for a more open and responsible Public Administration. The present research analyses the obstacles for the implementation of the Brazilian FOIA under the light of the international experience and the role of civil society related to the issue. We have considered that the Brazilian FOIA is widely ambitious and lacks institutional and legal instruments for its effectiveness. Besides, Brazilian civil society seems unaware of the right of information, making FOIA implementation at its desired width (all branches and all levels of government) even more difficult. As for the consequences of the FOIA towards accountability, we consider it might be strengthened if transparency becomes effective in Brazil after the FOIA implementation. However, more research is needed to convey the manner in which the strengthening process would occur.
