Infraestrutura de telecomunicaçõeso aluguel de espaço e sua definição judicial

Resumo

Based on the analysis of the negotiating model practiced by the market, the present work analyzes, quantitatively and qualitatively, rental review and renewal judicial actions, provided for in Law 8.245/1991, that discusses the adequacy of the rent for the installation of telecommunications infrastructure in private property. Since this infrastructure is crucial for the provision of Personal Mobile Service (SMP) and its current expansion aims to address the implementation of 5G technology, this discussion is essential. Furthermore, the adoption of minimum parameters for the production of expert evidence and the examination of its conclusions is suggested to ensure that the result is, in fact, the determination of the market price of the rent and to avoid distortions. Finally, the work suggests how to minimize the exposure to the risk of submitting the definition of the price to judicial litigation.
