Extractive resources & energy legal transition

Resumo

A first and intermediate objective of this research project is to analyze the regulatory and policy models for oil, gas, mining and geothermal. This analysis aims to make a contribution to understanding why and how selected countries decided to develop their energy resources in the manner chosen. This research raises at least the following questions: (1) What kind of energy sources should be analyzed? (2) To what extent these energy policies and regulations are similar or different from each type of energy resources? (3) How to achieve a sustainable transition between non-renewable and renewable resources without causing significant economic disruptions to the local economies and without jeopardizing environmental protections? (4) To what extent are the selected models suitable for replication within other jurisdictions and which precautions should be taken in replicating these models? The project will include one section describing the factual background for the development of energy resources policies for each selected country and for each specific energy resource. In the subsequent legal sections we will then endeavour to link the development of each legal regime to the factual background of each country. On this basis, we believe that a comparative legal analysis as such may contribute to shed important light on the questions above, although it will not be possible to provide a definitive answer to all aspects of the questions. A second and intermediate objective of this research project is consequently to analyse the regulatory models for energy resources within other type of energy resources. The precise energy resources and jurisdictions should be defined throughout the first 18 months of this project.
