Do outro lado da mesa – a desterritorialização das consultorias jurídicas da AGU na percepção dos órgãos assessorados

Resumo

Purpose: this study aims to examine the impact of implementing the new consultative work model of the Attorney General's Office in the states of Brazilian Federation (except the Federal Disctrict), according to the perception of the supported agencies on the service provided by the Consultancy Offices, as well as in the judicialization of actions regarding bids and contracts. Methodology: the research employed a qualitative method, combined with a quantitative approach, with a predominance of the former. Semi-structured interviews were conducted, using content analysis method for the development of categories based on respondents' answers. Secondary data from satisfaction surveys of Federal Executive Branch agencies assisted by the Office of the Solicitor General of the Union (AGU) for the years 2019, 2020, 2021, and 2022 were also utilized. Findings: the research showed an evident gain in speed in legal analysis, specialization and standardization of understandings. The losses are most felt due to the difficulty in accessing Attorneys for Brazil and the lack of knowledge about the reality of the public bodies or regional issues. Delimitations and Limitations: the research was limited to the analysis of services provided by units of the General Consultancy Office located in the states of the Federation (i.e., outside the Federal District), primarily focusing on procurement and contracts. The timeframe for this study was from 2018 to 2023 for secondary data collection. In interviews, efforts were made to interview officials from supported agencies who had direct contact with the consultancy's work before and after the implementation of the new model. Due to turnover in the procurement and contracts sectors of public agencies, there was difficulty in identifying and locating officials with more than 4 (four) years of experience in such sectors of supported agencies who were willing to be interviewed. To proceed, assistance was sought from State Legal Advisors, requesting recommendations of individuals fitting the necessary profile for the research, which may have introduced bias to the study, as it's possible that officials with closer proximity or access to the Legal Advisors were recommended. Another limitation relates to secondary data. The lack of precise data on the subjects of legal actions, making it difficult to separate those related to procurement and contracts, hindered the research on the effectiveness of the services provided. Practical implications: Attorney General's Office and General Consultancy Office can use the research to analyze the new organizational model and to learn a little more about the perception of the bodies it advises. The work may be useful to other public bodies in the process of deterritorialization and specialization. Contributions to society: the study is relevant for identifying issues and possibilities for improvement in the working model adopted since 2020 by the General Consultancy Office for advisory units located outside the Federal District. The study is also relevant for enabling reflection on the future of the consulting activity provided by the Attorney General’s Office (AGU). Originality: the research is original as it examines a still new model (adopted from September 2020); no works were found analyzing the new organizational model from the perspective of the bodies advised.
