Demanda social por geração sustentável de eletricidade a partir da instalação de parques eólicos e fotovoltaicosa transferência do ônus por impactos da nova tecnologia no território brasileiro

Resumo

The massification of energy generation from renewable sources is a necessity for the transition to a less carbon-intensive economy. The implementation of solar and wind farms is a significant contribution to strengthening the climate agenda. To prevent conflicts with a view to the success of this energy option, the following must be considered: renewable energy capacity; modus operandi of entrepreneurs; conditions of authorization by the Public Administration; and management of risks of loss of quality of life in areas of influence, types of damage and impacts and resulting threats, pollution and associated nuisances. The authors contextualize real and hypothetical social demands, in addition to briefly commenting on procedures, rules and principles of foreign legislation on the matter. There are legal regimes whose predictions provide additional grounds for regulating the matter in Brazil, in aid of making the right decision, that is, in which the entrepreneur interested in investing in the sector does so effectively with an eye on sustainability and, in this regard, considers the people of the localities affected by the implementation as essential parties, from the conception of the project idea, actively involving them before, during and after planning, without lacking the establishment of communication channels and improvements in the course of the project implementation.
