Autonomia e futuro da perícia oficial na percepção dos peritos criminais

Resumo
This study raised vision of future of the Brazilian Criminalistics as the autonomic perceptions of forensic scientists taking the law 12.030/2009 as parameter. The mentioned law has granted technical, scientific anIl functional autonomy to these professionals. For the making of this study, literature and field research were developed. The universe of the research was the forensic scientists. The field research consisted in lhe interview of 39 criminal forensics scientists - tlhe main group was composed by 31 experts, including local managers from Federal Institutions (Bazilian Federal Police, Federal Police of Brasilia, capital city) and State Police and Civil Public Security Bureau and a complementary group composed by four national managers and four national leaders of the aforementioned public organs. As a preparation for lhe following stages, the main gruup was given an evoke test with lhe words ''autonomy'' and ''forensic Science”. Both groups responded semi-structured interviews. The results were achieved by the technique of content analysis to the categories: The perception of autonomy by the experts; Scope of law 12.0301/09, Social role of the forensic scientist; Future of Brazilian Forensic Science. It was concluded that the Brazilian Criminal Forensic Scientist identified their essence with the discovery of lhe truth concerning a certain fact reported as crime It’s social role is understood as the official report delivered to lhe magistrate. However it is different from the perception of autonomy and future view. The experts under Federal regulations, understand the autonomy achieved according to the law and believe in the possibility of administrative autonomy inserted into the Police Instituitions. At the same time, state experts seek for more autonomy as an independent, integrated, nationwide organization closer to the judiciary, following the guidance of the UN (lslanbul Protocol) Law and Brazilian Decree 7.037/109. For all the interviewed the Law 12.030/09 only legitimized the state of affairs.
