Resumo

This paper examines the legal treatment of retirement for transgender people in Brazil, highlighting the absence of specific regulation in the current legislation. It discusses the main theoretical frameworks that attempt to address this gap and analyzes their implications for the realization of social security rights. Through a doctrinal and jurisprudential approach, the study identifies how Brazilian courts, particularly the Regional Federal Courts, have applied different interpretations in the absence of explicit norms. It further contextualizes the issue within Brazil’s socio-political reality, marked by structural transphobia and exclusion from the formal labor market, which significantly impact the life expectancy and financial security of the trans population. The research concludes that, in light of constitutional principles of human dignity, equality, and social inclusion, retirement according to gender identity must be guaranteed as a fundamental right, requiring legislative and administrative measures to ensure legal certainty and prevent discrimination within the social security system.
