Resumo

This thesis focuses on police accountability within the scope of the Military Justice of Brazilian states, in a country where the high lethality of police actions has had political and academic repercussions. The valorization of lethal episodes in scientific production, also a result of this scenario, while contributing to the description of the phenomenon, produced the invisibility of harmful conduct with results other than death, as well as institutional responses to them. Given this context, the thesis proposes to answer the following question: what are and how were Brazil's institutional choices regarding the accountability of military police officers constructed? Methodologically, data collection and processing strategies were designed in which we sought to use public documents, observation of court hearings, and interviews, formal and informal, with legal-procedural actors, notably military police officers and magistrates. When seeking to understand the way in which a specific institutional design of accountability was progressively constructed and operationalized, from the beginning of the Republic to the 2020s, the research reveals that both the military police, subjects in judicial processes, and the military police, an organization public, have their own trajectories in relation to Military Justice, whose institutional design reflects a legal engineering that is the product of political disputes and agreements. The invention, a product of this engineering, is capable of producing accusations, processes and sanctions for abusive and/or illegal conduct by military police officers, on the one hand, and institutional racism, on the other hand, showing that in Brazil we can have a diversity of senses of control, public transparency, and accountability of military police officers and, at the same time, a sophisticated system of institutionalized racial inequality.
