Resumo

The present work has as it central subject matter the study of the legal obstacles faced by cultural institutions concerning the disclosure of personal collections and archives. It analyses the development of the notion of memory and heritage through history, addresses the concepts from the Brazilian, legal and political point of view, studies the legislation concerning archives and verifies its adequacy in allowing the full exercise of the cultural rights established by the Brazilian Federal Constitution of 1988, as long as such rights are exercised through partnerships between the Government and private institutions permitted by the Brazilian Legislation concerning incentives for the granting of cultural benefits. The work offers as an annex the Clearance Manual, which suggests that the clearance of the copyrights and neighboring rights, shall be made through the granting of licenses and other legal instruments, along with the applicable legislation.
