A nova Lei de Licitações e a análise do critério “Técnica e Preço” nas contratações públicas de serviços técnicos de engenharia consultiva

This study analyzes the implementation of the "Technical and Price" criterion from Law No. 14.133/2021 in the public procurement of specialized technical consulting engineering services. It adopts a qualitative approach of an interpretative nature, conducting 15 semistructured interviews with representatives from the public sector, private sector, professional associations, and control bodies. Data was complemented by documentary and normative analysis. The evidence was triangulated with national indicators from the Federal Court of Accounts (TCU). From a reflexive thematic analysis, five central themes emerged: gaps in institutional and technical capacity, systemic implementation barriers, cultural and behavioral resistance, complexity of technical evaluation, and professional and service valuation. The themes reveal operational and institutional challenges that prevent the effective adoption of the "Technical and Price" criterion and, simultaneously, its transformative potential to improve the quality of public contracts. This study provides the first empirical analysis of the implementation of Law 14.133/2021 in consulting engineering services and demonstrates that the "Technical and Price" criterion achieves a superior balance between technical quality and economic feasibility in the context of complex procurements. The documentary analysis reveals that excessive discount percentages compromise contract execution capacity, emphasizing the need for criteria that prioritize the technical quality of services. It identifies paths for institutional strengthening, including the standardization of criteria, staff training, and the alignment of control bodies. These results have broader implications for public contract reform in developing countries transitioning from procurements based on the lowest price criterion to value-based approaches.
