A discriminação indireta como entrave para a inclusão de docentes negros na carreira de Magistério Superioruma análise da Lei nº 12.990/2014 à luz da CRFB/88.

Resumo

The main purpose of this monograph is to investigate the effectiveness or ineffectiveness of Law No. 12.990/14 in terms of including black people on the teaching staff of federal universities in the state of Rio de Janeiro. To this end, it will first explore historical aspects of this issue, considering the various challenges and violence suffered by black people since the abolition of slavery in Brasil. Next, the constitutional paradigm of equality is evoked, in order to understand the notion of equality as a principle of non-discrimination. In this sense, mechanisms to combat discrimination and, in particular, affirmative action, are imposed. The history of affirmative action is then explored, to arrive at the quota laws published in Brazil since the 2000s, with a specific focus on Law 12.990/14, which deals with the reservation of vacancies for black candidates for teaching positions at federal universities. Through an analysis of the effectiveness of this law, the problem of the under-representation of black people in spaces of power in the Public Administration is investigated, hypotheses are raised about the problem and a creative vision is proposed for its solution.
