A alienação fiduciária de imóveis em garantiacontexto histórico e os obstáculos da sua utilização fora do sistema financeiro de aquisição de imóvel

Resumo

The present work aims to make a brief analysis of the evolution of the guarantee system in Brazilian law, as well as the origin of the fiduciary alienation institute, especially on the historical context of the creation of the provision of such guarantee also in relation to immovable property (Law N. 9,514/97), with the justification of creating an instrument to encourage the development of the real estate market. Despite being designed for a specific market, this type of guarantee has become widely used in various sectors of the economy, due to its specificities and the fact that foreclosure takes place out of court. Within this scenario, the numerous measures of dejudicialization existing in laws and projects will be dealt with in order to give more efficiency in the realization of rights, especially in the face of the crisis and slowness of the judiciary. In this context, it is intended to address the obstacles that still exist in the legislation when using the fiduciary alienation in guarantee of real estate outside the real estate acquisition market, more specifically in relation to the possibility of guaranteeing future or conditioned credits and the collection of the remaining balance of the debt. after the auctions are held. Once this is done, an attempt will be made to assess how, and if, eventually, the parties could contractually overcome these obstacles. At the end, as a suggestion, some precautions were listed to be observed in the instruments of constitution of the guarantee to avoid the risks pointed out when using the fiduciary alienation of real estate in guarantee of obligations not arising from the acquisition of the property.
